Your privacy is important to us as is providing you the best possible products and services.  Use of the SpotOn collar by itself does not provide information beyond the collar. Registering the collar, or using the collar in conjunction with cell phone communication, our app or our web site results in information being shared, stored in the cloud, and stored on Company servers. By using this website and/or any of our connected or registered products, services or applications, including the SpotOn app, hardware such as the SpotOn collar with cell phone and/or app/web connectivity, or software (collectively, the “Services”), or other services, including, without limitation, when you access the Services through mobile devices, you agree to our Privacy Policy, and that we may process, transfer and store your information in the United States and elsewhere as permitted herein. IF YOU DO NOT AGREE WITH OUR POLICY, DO NOT USE OUR PRODUCT OR SERVICES, OTHER THAN THE USE OF THE COLLAR BY ITSELF WITHOUT CONNECTIVITY. We may change our policy from time to time. We will post these changes on this website. We encourage you to periodically review our Privacy Policy.

We may collect personal information (including name, address, telephone number, email address, device location, transaction information, credit card information, and pet information such as name, date of birth, breed type, device location, distance device has travelled, saved maps, and saved waypoints) when you do any of the following:

  • Place an order from our website
  • Inquire about our products
  • Register your product
  • Return an item or make an exchange
  • Contact customer support or technical assistance
  • Obtain software updates
  • View newsletters
  • Access our products or services on social networks
  • Use services provided online, by way of your mobile device or the SpotOn™ software
  • Sign up for updates regarding your products
  • Are referred to us through a marketing promotion
  • Upload or post to the Services
  • Create, activate, or manage maps

OPS automatically collects certain non-identifying information about you (such as your movement about the website and mobile app, the pages you visit most frequently, the type of browser or computer operating system you use, or the domain name of the website from which you link).

In addition, OPS may collect certain information automatically, including, but not limited to, the type of device you connect to or monitor through the Service, your devices’ unique device ID, the IP address of your devices, your operating systems, the type of internet browsers you use, information about the way you use the Services and activity on your network that the Services monitor.

OPS may collect other passive information using technologies such as standard server logs and cookies to determine your preferences and track your search terms and other behaviors or activities as you navigate around the Internet (collectively, “User Behavior”). If you object to this practice, you may select the blocking of cookies, though doing so may affect your use, and performance of, the Services.

We will never keep or store your credit card information. All credit card information is processed through a secure, encrypted connection using Payeezy and Authorize.net as our trusted payment gateways. Other than the foregoing, you acknowledge and agree that any other personal information that you may voluntarily disclose to OPS or through the Services is at your own risk and that WE ARE NOT RESPONSIBLE FOR THE COLLECTION, STORAGE OR USE OF ANY SUCH PERSONAL INFORMATION THAT YOU VOLUNTARILY DISCLOSE TO OPS.  OPS STRONGLY ENCOURAGES YOU NOT TO DISCLOSE ANY PERSONAL INFORMATION ABOUT YOURSELF OTHER THAN IS NECESSARY TO PURCHASE AND USE THE SERVICE FOR ITS INTENDED PURPOSE.

Using the Information We Collect

We always want to provide you with the best user experience possible. To allow for this, we collect information that enables us to:

  • Provide confirmation emails – verify user name and password
  • Process and track your order
  • Provide the services you request
  • Contact you regarding the status of an order
  • Send you email updates
  • Improve our products and services
  • Create, activate, or manage maps
  • Troubleshoot any issues you may have creating or managing perimeter maps
  • Troubleshoot any issues you may have using our products or services

Information we share with others

We contract with other companies who provide us with certain services, including, without limitation, hosting, market research, data analytics, third party advertising, promotions management and payment processing (you may request a copy of Payeezy’s privacy policy by sending a request to dataprivacyoffice@firstdata.com.  You may also view a copy of Authorize.net’s privacy policy by visiting their website at www.authorize.net.) We provide these companies with only the information they need to perform their services and require them to ensure that your privacy is protected. These companies are prohibited by contract from using this information for their own marketing purposes or from sharing this information with anyone other than OPS. We may be required to disclose your information to government or law enforcement officials in response to a lawful request by a public authority or in order to comply with a legal obligation, including to meet national security or law enforcement requirements. We can also disclose your information in order to apply or enforce our terms of use, or to respond to any claims, to protect our rights or the rights of a third party, to protect the safety of any person or to prevent any illegal activity (including for the purposes of fraud protection and credit risk reduction).

Additionally, we will not sell or transfer to unaffiliated third parties any personal information that you submit without your consent, provided, however, that in the event that OPS is sold or transferred, or in the event that substantially all of our assets are sold or transferred to a third party, the Service and any personal information collected by us, will be among the transferred assets.  By using the Service, you hereby agree to such transfer or assignment of your personally identifiable information collected by us, and you further waive any claims that could be made against us in relation thereto.

How We Use Email

When you provide us your email address, we will email you as necessary to process your order, confirm your user name and that you established a password, confirm product registration, respond to a request, or provide customer service. For example, after you place an order at SpotOn you will receive an email order confirmation and, in most cases, an email with package tracking information.

We may also send promotional emails about products, training tips, unique ways to use the SpotOn Virtual Smart Fence™ system, other user experiences, maps for public spaces, special offers, services or events we believe may be of interest to you. It is our intent to send promotional emails to only those who wish to receive them. We provide a means to unsubscribe in each email.

When registering the product, you must create an account and thereafter maintain a valid and active email address. We use your provided email as your account name. Information regarding your account will go to your designated email. We will never send a password or password change without your request.

We may also send email notifications regarding the status of the Service to those who have registered their email address. If you chose to no longer receive status notifications to your email, you have the opportunity to delete the email notification in the account settings.

SpotOn Devices

When you connect your device to cell phone service, the internet or visit our website, we may automatically receive certain information about your device and your use of it, including serial number, firmware version, log files, settings, durations, error rates, maps you have created and stored, whether your dog is inside or out of the containment area, your dog’s location if out of containment, and other similar usage information. This information helps us to improve our products and services, troubleshoot bugs, and analyze errors.

Location Information

As part of our Product and Services we gather and use location information. Information regarding the location of the product is used when using our Services. This location information provides you the ability to know where your pet is located through a notification sent or a query on the Site or Application. When locating your pet on the Mobile Application, your hardware location information is used to provide information of your location relative to your pet’s location. If you chose to not use Location Services, you cannot Track your Pet or obtain your pet’s location. This location data is collected anonymously in a form that does not personally identify you.

Use of Apps

When you download and use apps, we and our service providers may track and collect app usage data, such as the date and time the app on your device accesses our servers and what information and files have been downloaded to the app based on your device serial number. OPS uses a third-party service provider to collect analytical information related to the use of its mobile app, such as device state information, device hardware and OS information, as well as information relating to how an app functions. This information is collected and stored in a way that does not personally identify any particular user. OPS retains all rights, title, ownership and other interests in and to this data and uses this data to improve the quality and functionality of its Service and otherwise as permitted by applicable law.

Security

It is our intent to protect against the misuse, alteration or loss of information that we have collected from you or received from a partner. We use the latest technology and processes for protection of your information. We use encryption whenever we receive or transmit information. Notwithstanding the foregoing, OPS cannot guarantee the security of your personal information. When you communicate with OPS electronically or otherwise submit your personal information, your communication is not necessarily secure and is subject to all of the risks of communication, including unauthorized entry or use, hardware or software failure, and other factors that may compromise the security of Personal Information at any time. 

Links to other Sites

We may provide links on our website or through the Service to other sites that support, or provide advice for using our products. These sites have their own privacy, terms of use and security policies. We encourage you to read these policies as they are independent of OPS.

Children’s Privacy

The Services are not targeted to children under the age of 18.  Should we be made aware of information of a child under the age of 18 that has been unintentionally gathered, we will delete as soon as possible.

California Privacy Rights

Under California’s "Shine the Light" law, California residents who provide Personal Information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2018 will receive information regarding 2017 sharing activities).

We will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response
